Welcome to Bardot  and Bardot Junior website.  Before you may become a Bardot member, you must first read, agree with and accept all of the terms and conditions stated in this User Agreement and Privacy Statement (terms and conditions of this are set out below).  By registering as a customer with Bardot, you are accepting the terms and conditions outlined below and the Customer Privacy Statement which includes those terms and conditions expressly set out and those incorporated by reference.  You should also access and read the information contained in the other pages and websites referred to in this document and that appear on our website, as they do and may contain further terms and conditions which apply to you as a Bardot member.  If you have any questions please contact us via email at online@bardot.com.au

Bardot may at its absolute discretion amend the terms and conditions from time to time by posting the amended terms and conditions on the website and such will be effective as at that date.   Should you not agree with such changes, you must terminate your membership of Bardot by email notification to online@bardot.com.au
The terms and conditions outlined here may be amended from time to time without notice to you and will apply to orders placed effective as at the date of amendment.

Once an order has been confirmed, no changes to the order will be made.

Customer registration
In order to become a registered customer, you must be able to enter into a legally binding contract under relevant laws and you must not be a suspended Bardot member.  Your account may not be transferred or sold to another party.
 
Application to be completed:   A customer must complete a registration form before placing an order for goods with Bardot.   This is located on the website by link reference.
You warrant that all information and data provided by you during this registration process is accurate, complete and up to date.  You must promptly inform Bardot if there is a change to this information or data.

You must take responsibility for the safekeeping of your username and password. Upon completion of a transaction/ website visit to Bardot, it is advisable to log off to ensure your personal information submitted to Bardot is not used by the next person on the computer. You are liable for any activity if your username and password are used by an unauthorised person.   You release and indemnify Bardot in relation to any liability arising out of the unauthorised use of your username or password.   If you suspect or know that someone has stolen or obtained your username and password you must contact Bardot in writing to cancel and/or change same.

For security purposes, Bardot is entitled to request credit card verification at their discretion.   Otherwise, Bardot reserves the right not to proceed with the order sale and refund the payment made.

A customer is prohibited from purchasing goods from Bardot for the purpose of resale and on sale to other persons whether as a business or non business and goods are only for personal use including but not limited to gifting and/or on behalf of another for their personal use.  A breach of this will result in cancellation and/or refusal of registration/ order for goods.

Delivery
Bardot can combine Bardot and Bardot Junior online purchases. All you have to do is add the items to the shopping bag on the site you are currently shopping on. Go to the other section, continue shopping and then check-out with the items in your shopping bag. Only one delivery fee will be charged.
Australia-wide orders
You can choose delivery with express post for a flat rate of $12 or $8 for regular post Australia-wide. If you make a purchase online for $80 or more you will automatically be entitled to free delivery via express post. Please note to receive a parcel a signature is required. If no one is home when initial delivery is made, a card from Auspost will indicate a failed delivery attempt, and you can pick up your parcel from the post office indicated on the card.

Orders placed after 2pm will be sent by the following business day. Please note express post delivery may not apply to your region. To find out if your delivery address falls under the express post network visit Australia Post http://auspost.com.au/personal/express-post-network-vic-tas.html

It takes one – two business days via express Post or three – five business days via regular delivery Australia-wide. For international orders, it can take up to seven business days to reach you. If you have not received your purchase within the duration stated above please contact customer service immediately.   Please note express post delivery might not apply to your region. An email will be sent to your email address when your purchase leaves the warehouse. You can also opt to be notified via SMS. The email or SMS will contain the package’s tracking number. You can track the delivery status by entering the tracking number into this link: http://auspost.com.au/track/

Overseas orders
Bardot delivers internationally via Australia Post to selected countries. Please allow up to 10 working days for the parcel to reach you: .

Returns Policy
Bardot may exchange or give a credit note (valid for 6 months from issue date) for a change of mind purchase subject to several conditions:
•    Goods must be returned within 14 days of purchase with original docket
•    Does not apply to goods reduced for sales purposes
•    Does not apply to sales of accessories, hosiery, lingerie or swimwear
•    The goods cannot have been worn, washed, used, soiled or damaged by the customer
•    Shipping and handling costs are not refundable
Refund will only be made on damaged or faulty goods.  

Defective and damaged products
Goods are inspected before packaging to ensure they are in excellent condition. Products are packaged carefully to ensure a minimal chance of damage during transit. If you receive a damaged or defective item please contact Bardot within 14 days of purchase to be eligible for an exchange or a refund.

Size change
Bardot is happy to provide a size exchange.  However, postage and handling charges incurred by you and by Bardot to resend to you will be at your cost.

How to return
If you have satisfied the return conditions you can exchange your purchase, within 14 days of purchase with the  original receipt, at any Bardot store, subject to Store Manager’s approval.*

It is recommended  that you (1) use a traceable delivery method for all returns and (2) either insure your delivery for safe return to Bardot or declare the full value of the shipment so that you are completely protected if the shipment is lost or damaged in transit. If you choose not to (1) use a delivery method that offers tracking and (2) insure or declare the full value of the product, you will be responsible for any loss or damage to the product during shipping.

Fraud
Registering on line with Bardot, means you warrant that all details you supply to Bardot are correct and accurate.  As the accuracy of all personal details provided by users cannot be confirmed, Bardot takes no responsibility for the inaccuracy of details and/or the false identity of any user.  Bardot may suspend or terminate your membership at any time in its sole discretion, if Bardot suspects, proves and/or determines in the circumstances that you are or have been engaged in any fraudulent activity in relation to the website.  Bardot reserves its rights to take any applicable and available legal action against you for fraudulent and misleading and deceptive conduct.

Product information
Effort is made to display accurately the colours of products that appear on the website. However, as the actual colours you see will depend on your monitor, there is no guarantee that your monitor's display of any colour will accurately reflect the colour of the product on delivery.

All sizes and measurements stated are approximate sizes and measurements and every effort is made to ensure accuracy.  Please refer to the size guide for clarification.

All reasonable care is taken to ensure that all details, descriptions and prices of products appearing on the website are correct at the time when the relevant information was entered onto the system.  Bardot reserves the right to refuse orders where product information has been published in error and this includes but is not limited to incorrect or misstated prices and promotions.

Prices are subject to change without notice. Prices are inclusive of GST and in Australian dollars.

Goods are subject to availability.  An order for goods is accepted at the time of entering of your credit card details.  Payment will be validated and accepted real time.  If a good/ goods  you have ordered is/are out of stock, you shall be notified as soon as possible and your payment will be refunded to the credit card  or Paypal account used for the transaction.

PAYMENT METHODS
At Bardot online, we accept Mastercard, Visa, Amex and Paypal.
If you have opted to use the cheque service via Paypal, the order will only be processed when the payments are cleared and the status in your account is updated to complete.  Please allow 3 – 5 business days of processing and delivery.

ORDERS
On the placement of an order on the website you will receive an email of acknowledgement. It takes one – two business days via express Post or three – five business days via regular delivery Australia-wide. For international orders, it can take up to seven business days to reach you. Please contact Bardot if you have not received your purchase within this period.

Once you have checked out and your order has been confirmed, you will not be able to make any changes to your order so please ensure that the order is correct before clicking the confirm button.

Any discounts triggered by the entry of a promotional code will not be applied until payment is validated and will be detailed on the invoice.  Bardot reserves the right to refuse an order. Non-acceptance of an order may include but is not limited to:
- The product ordered is unavailable from stock
- The inability to obtain authorisation of payment
- The identification of an error within the product information, including price or promotion
If there are any problems with your order, Bardot will contact you. 

There is a continual update of the Bardot online store.  From time to time, Bardot and related company retail stores may run special local promotions (which may not be available on the website) and there may be special offer discounts on the website that are not available in the retail stores.  Some website promotions may not be available to customers in particular jurisdictions. 

Bardot VIP card (Loyalty Program)
VIP members who hold a Bardot 10% off membership card can now use it when purchasing online. If you don’t hold a VIP card you can get one on request when you spend $200 or more in store. The discount will only be applied to full price items and the final price will be printed at the checkout page.  When you spend $200 or more online on full price items Bardot will send you a Bardot VIP card automatically.
General
For further details regarding the use of data supplied by you, please refer to the Customer Privacy Notice.   Bardot shall not be liable to any person for any loss or damage, which may arise from the use of any of the information contained in any of the materials on this website.

Bardot Guilty Secrets

Terms and Conditions

 

 

1.         By entering the “Bardot Guilty Secrets Competition” (“Competition”) organised by Bardot Clothing Pty Ltd ABN 61 074 147 434 of 63 Victoria Crescent ABBOTSFORD (the “Promoter”), you as entrant and (“Entrant”) will accept and are bound by the following terms conditions.

 

2.         Entry to the Bardot Guilty Secrets Competition is by the Bardot Facebook Page www.facebook.com/Bardotfashion application powered by Peazie.

 

3.         Entrants will be required to provide their details, including but not limited to their first name, last name, email address and telephone number. Incomplete, misdirected or illegible entries will be ineligible.

 

4.         The competition commences on 13th February 2013 at 12.00pm EST and concludes on 6th March 2013 at 05.00pm EST.

 

5.         To enter you must select one of the four provided photographs in the facebook application.

 

6.         Employees of Bardot their immediate families and their associated agencies and companies associated with the promotion are ineligible. People who have won a competition with Bardot within the last 12 months are also ineligible.

 

7.         All entries remain the property of the Promoter and may be entered into a database for future marketing or promotional activities. By entering the Competition entrants, in the event that they are a winner, consent to the publishing of their names and photo on facebook, twitter & Instagram and on the Bardot Style File bardotstylefile.com.au. The Promoter will not use the entrants’ personal information for any other purpose without their consent unless required or authorised to do so by law. Entrants must notify the Promoter in writing if they would like to amend their personal information or if they have any queries as to how their personal information will be used.

 

8.         The judges' decision is final and no correspondence will be entered into.  Prizes cannot be transferred. Prizes cannot be redeemed for cash. Three weekly winners will be announced.  These winners will be chosen on the following dates; at 9.00 am on February 21st, February 28th and March 7th 2013. The grand prize winner will be chosen on 8th March at 9.00am (EST) at Bardot Head Office, 63 Victoria Crescent ABBOTSFORD, VICTORIA in its absolute discretion. The Promoter reserves the right to verify the validity of entries. Bardot reserves the right to disqualify any Entrant for tampering with the entry process or for submitting an entry that is not in accordance with these Terms and Conditions.

 

9.         No responsibility will be accepted for late, lost or misdirected entries. All entries are deemed to be received at the time of receipt into the Promoter’s database, and NOT at the time of transmission by the Entrant.

 

10.     The Promoter reserves the right to request the winner to provide proof of identity and proof of residency at the nominated prize delivery address. Identification considered suitable for verification is at the discretion of the Promoter.

 

11.     Prize winners are advised that tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of the prize.

 

12.     The Promoter reserves the right to refuse to allow a winner to take part in any or all aspects of the prize, if the Promoter determines, in its absolute discretion, that a winner is not in the mental or physical condition necessary to be able to safely participate in the prize. It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.

 

13.     If for any reason this promotion is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the promoter, which corrupt or affect the administration security, fairness or integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to disqualify any individual or Entrant who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the competition.

 

14.     The winners will be notified by email and phone on the address and numbers provided by the Entrant.

 

15.     Prize values are the recommended retail value as provided by the supplier and are correct at time of printing. All prize values are in Australian dollars and include GST.

 

16.     The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to direct or consequential loss) or for any personal injury suffered or sustained in connection with any prize/s except for any liability which cannot be excluded by law.

 

17.     All winning entries will be entered into a database and the Promoter may use the Entrants' names, addresses and telephone numbers for future promotional, marketing and publicity purposes in any media worldwide without notice and without any fee being paid.  The Entrant may advise the Promoter that the Entrant does not wish to be contacted in this regard.

 

18.     Prizes and values are as follows: 3 weekly prizes of Le Tan Bronzing Packs valued at $100 each, and 1 Grand Prize valued at $1000.

 

19.     The winner releases the Promoter and other organisers, their related bodies corporate, affiliates, officers, agents and employees, from all liabilities, loss and damage of any kind arising at any time out of or in connection with the acceptance of, and participation in, the prize. Without limiting the foregoing, the released parties not be liable for any injury, sickness or death, property loss or damage or other direct or indirect loss or damage of any kind, howsoever sustained or incurred, in connection with or arising out any other aspect of the prize.

 

20.     In the event that for any reason whatsoever a winner does not take an element of the prize at the time stipulated by the promoter then that element of the prize will be forfeited by the winner and cash will not be awarded in lieu of that element of the Prize.

ON Safari Competition

BARDOT Terms & Conditions

  

1.     By entering the “On Safari” (“Competition”) organised by Bardot Clothing Pty Ltd ABN 61 074 147 434 of 63 Victoria Crescent ABBOTSFORD (the “Promoter”), you as entrant and (“Entrant”) will accept and are bound by the following terms conditions.

2.     The competition commences on 20th February 2013 at 9.00am, EST and concludes on 13th march 2013 at 5.00pm EST.

3.     To enter a customer must spend $100.00 in store in one single transaction to receive one entry into the competition. For every subsequent $40.00 spent in store prior to the close of the competition on the 13th March 2013 the customer will be rewarded with an additional entry.

4.     Entrants will be required to provide their details, including but not limited to their first name, last name, email address and telephone number.

5.     Should the winning entrant be a minor, he or she must be accompanied by a parent or guardian during all stages of the prize trip

6.     All entries remain the property of the Promoter and may be entered into a database for future marketing or promotional activities.


 

7.     In the event a contestant is a winner, he or she consents to the publishing of his or her name on the Bardot Junior website, and Bardot Junior Facebook. The Promoter will not use the entrants’ personal information for any other purpose without their consent unless required or authorised to do so by law. 19.                        Prizes and values are as follows:

·        Tented safari accommodation as described in the two packages below

·        Either:

§  Taronga Zoo – Roar and Snore Safari (up to 4 people), or

§  Bardot Junior outfits and apparel to the total value of $250
