By entering the “Bardot Street Style Voting Competition” (the “Competition”) organised by Bardot Clothing Pty Ltd ABN 61 074 147 434 of 63 VICTORIA CRESCENT ABBOTSFORD (the “Promoter”), you (a “Voter”) will accept and are bound by the following terms and conditions.
To vote, a Voter must complete the online entry form at www.bardot.com.au and vote for their favourite Bardot Street Style entrant from a selection of entrant photos as uploaded and featured on the Bardot website. Voters will be required to provide their details, including but not limited to their own name, address, postcode and telephone number. Incomplete, misdirected or illegible entries will be ineligible. Only one vote per person will be accepted per day.
Voting is open to all permanent residents of Australia aged 18 or over, except a person who has won a competition with Bardot within the last 12 months. Employees of Bardot, their immediate families and their associated agencies and companies associated with the promotion are also ineligible.
The competition commences at 9.00am EST on 25 May 2011 and concludes at 9.00am EST on 15 June 09.00am EST.
The judges' decision is final and no correspondence will be entered into. Prizes cannot be transferred. Prizes cannot be redeemed for cash. The winners will be chosen on 15 June 2011 at 9.00am EST at Bardot Head Office, 63 VICTORIA CRESCENT ABBOTSFORD, VIC, in its absolute discretion. The Promoter reserves the right to verify the validity of votes. Bardot reserves the right to disqualify any Voter for tampering with the entry process or for submitting a vote that is not in accordance with these Terms and Conditions.
No responsibility will be accepted for late, lost or misdirected votes. All votes are deemed to be received at the time of receipt into the Promoter’s database, and NOT at the time of transmission by the Voter.
The Promoter reserves the right to request the winner to provide proof of identity and proof of residency at the nominated prize delivery address. Identification considered suitable for verification is at the discretion of the Promoter.
Prize winners are advised that tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of the prize.
The Promoter reserves the right to refuse to allow a winner to take part in any or all aspects of the prize, if the Promoter determines, in its absolute discretion, that a winner is not in the mental or physical condition necessary to be able to safely participate in the prize. It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.
If for any reason this promotion is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the promoter, which corrupt or affect the administration security, fairness or integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to disqualify any individual or Voter who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the competition.
The winners will be notified by email and phone on the numbers provided by the Voter.
Prize values are the recommended retail value as provided by the supplier and are correct at time of printing. All prize values are in Australian dollars and include GST.
The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to direct or consequential loss) or for any personal injury suffered or sustained in connection with any prize/s except for any liability which cannot be excluded by law.
All winning voters will be entered into a database and the Promoter may use the Voter’s names, addresses and telephone numbers for future promotional, marketing and publicity purposes in any media worldwide without notice and without any fee being paid. The Voter may advise the Promoter that the Voter does not wish to be contacted in this regard.
Prizes and values are as follows 1 x $150 Bardot voucher; Total value of prize pool is $150 as at 20 May 2011.
The winners release the Promoter and other organisers, their related bodies corporate, affiliates, officers, agents and employees, from all liabilities, loss and damage of any kind arising at any time out of or in connection with the acceptance of, and participation in, the prize. Without limiting the foregoing, the released parties not be liable for any injury, sickness or death, property loss or damage or other direct or indirect loss or damage of any kind, howsoever sustained or incurred, in connection with or arising out any other aspect of the prize.
In the event that for any reason whatsoever a winner does not take an element of the prize at the time stipulated by the promoter then that element of the prize will be forfeited by the winner and cash will not be awarded in lieu of that element of the Prize.
